Fundamental Provisions

These Terms and Conditions (hereinafter: Terms) govern the use of the internet portal www.autoservice.world, managed by Melior Consuasor d.o.o., with its registered address at Vladimira Nazora 10, 10431 Brezje, Croatia, OIB 86651636991 (hereinafter: Portal Owner).

Melior Consuasor d.o.o. operates under the trading name AUTOSERVICE.WORLD.

Through the Portal, Melior Consuasor d.o.o. sells digital listing rights to registered business users, offered as one-time listing packages or monthly subscriptions.

Separately from that service, the Portal enables registered business users to publish their own listings. Publishing a listing on the Portal does not make the Portal or the Portal Owner the seller or service provider for the product or service listed. The seller or service provider is the person or business entity identified as such in the specific listing.

Definitions

Portal means the internet portal www.autoservice.world, intended for business cooperation, trade and exchange between automotive service providers.

Portal Owner means Melior Consuasor d.o.o.

User means any person who accesses or uses the Portal, including unregistered visitors, registered users and business entities that use Portal services on the basis of a contractual relationship.

Digital listing rights means the rights purchased from Melior Consuasor d.o.o. that enable a registered business user to publish a specified number of listings under the conditions presented before purchase.

Seller or service provider means the person or business entity identified as the seller or service provider in a specific listing.

General Provisions

By accessing or using the Portal, the user agrees to comply with these Terms.

The Portal Owner reserves the right to modify, supplement or update these Terms. Amendments take effect on the date of publication unless stated otherwise or required by applicable mandatory law. Users are responsible for reviewing the current Terms when using the Portal.

Registration and User Account

User Registration

Registration and creation of a user account are required to use certain Portal functionalities and services. Creating an AUTOSERVICE.world business account is free of charge.

During registration, the user must provide accurate, complete and up-to-date information and keep it current throughout the use of the Portal. The user is responsible for the accuracy of all submitted information.

By registering, the user confirms that they are authorized to use the submitted information and that all information provided to the Portal is truthful and lawful.

The Portal Owner reserves the right to verify the user’s identity, business status or other information relevant to the use of Portal services.

Removal of Content and User Accounts

The Portal Owner may, in accordance with these Terms and applicable law, temporarily or permanently remove content published on the Portal if it determines that the content is inappropriate, unlawful, inaccurate, misleading, offensive or otherwise contrary to applicable law, these Terms or the purpose of the Portal.

Inappropriate content includes, in particular, content unrelated to the activities for which the Portal is intended, content that infringes third-party rights, contains false or misleading information, promotes unlawful activities or otherwise compromises the reputation, security or functionality of the Portal.

The Portal Owner may temporarily restrict or permanently disable access to a user account if the user violates these Terms, publishes inappropriate content or uses the Portal contrary to its intended purpose.

In the event of a serious or repeated violation, the Portal Owner may permanently remove the user account together with the content published through that account. The user is not entitled to compensation solely because such a measure has been taken. Any right to a refund for purchased listing rights is determined in accordance with the Refund and Complaints Policy and applicable mandatory law.

Obligations and Responsibilities of the User

The user must use the Portal in accordance with applicable law, these Terms and good business practices.

The user is solely responsible for the accuracy, completeness and lawfulness of all information, listings and content published through their account.

The user must not:

• publish inaccurate, misleading or incomplete information;
• publish content that infringes third-party rights, including intellectual property rights;
• use the Portal for fraud, unlawful activities or any form of abuse;
• publish content that is inconsistent with the purpose of the Portal;
• publish content that is offensive, discriminatory, unlawful or otherwise harmful to other users or the Portal Owner;
• attempt to gain unauthorized access to the Portal, other user accounts or data; or
• disrupt the operation of the Portal or compromise its security or functionality.

The user is responsible for all activities carried out through their user account, regardless of whether they were performed by the user or by a third party who had access to the user’s login credentials.

If the user violates these Terms, the Portal Owner may remove content, restrict access or deactivate the account in accordance with these Terms and applicable law.

Listings and Published Content

Users may publish listings on the Portal exclusively for business cooperation within the activities for which the Portal is intended.

The user warrants that all information published in a listing is accurate, complete and up to date and does not mislead other users.

Published content must comply with applicable law, these Terms and the purpose of the Portal.

Users must not publish content that, in the reasonable assessment of the Portal Owner and in accordance with the Portal’s editorial policy:

• is unrelated to automotive service activities or related products or services;
• contains inaccurate, misleading or false information;
• infringes third-party rights, including intellectual property rights;
• promotes or relates to unlawful activities, products or services; or
• compromises the reputation, security or functionality of the Portal.

The Portal Owner does not create or approve listings published by users and does not assume responsibility for the accuracy, completeness or lawfulness of user-provided information.

The Portal Owner may remove, modify or restrict access to content that violates these Terms or is inconsistent with the purpose of the Portal, in accordance with these Terms and applicable law.

Liability of the Portal

In relation to products and services listed by users, the Portal provides the technical functionality for publishing listings and connecting users. Publishing a listing does not make the Portal Owner a party to an agreement between the buyer and the seller or service provider identified in that listing.

The Portal Owner does not guarantee the accuracy, completeness, lawfulness, quality, safety or availability of products, services or information listed by users.

Users independently assume the risks associated with entering into and performing business transactions concerning products or services listed on the Portal.

To the extent permitted by applicable law, the Portal Owner is not liable for direct or indirect damage, loss of profit, loss of data or other consequences arising from business dealings between users or from products, services or information listed by users. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

The Portal Owner does not decide disputes between buyers and sellers or service providers. However, following a report of a dispute, abuse or suspected violation of these Terms, the Portal Owner may review the use of the Portal and restrict access to a user account or content where justified.

This section does not limit the obligations of Melior Consuasor d.o.o. concerning digital listing rights sold by Melior Consuasor d.o.o.

Business Relationships Between Users

Business relationships concerning products or services listed by users are established directly between the buyer and the seller or service provider identified in the relevant listing.

The seller or service provider identified in the listing is responsible for the listed product or service, the accuracy of the information in the listing, the agreed terms, price, payment, delivery, performance, complaints, product returns and refunds.

The buyer resolves complaints, returns, refund requests and other disputes concerning a listed product or service directly with the seller or service provider identified in the listing.

The Portal Owner is not responsible for the performance of obligations arising from such a business relationship, including the quality, conformity, lawfulness, availability, delivery or payment of the relevant product or service, except where such responsibility follows from applicable mandatory law.

Personal Data Protection

Users’ personal data are collected and processed in accordance with applicable personal data protection law and the Privacy Policy published on the Portal.

By using the Portal, the user confirms that they have been informed about the processing of personal data.

Intellectual Property

Content provided by the Portal Owner, including text, logos, graphic elements, design, databases and software, is protected by applicable intellectual property rights.

Copying, distributing, modifying or otherwise using content provided by the Portal Owner is prohibited without prior written permission, except where permitted by applicable law.

The user retains rights in the content they publish. The user grants the Portal Owner the right to use that content to the extent necessary for the operation, display and promotion of the Portal and the user’s listings.

Payments and Subscriptions

Melior Consuasor d.o.o. sells digital listing rights as one-time listing packages and monthly subscriptions. The specific scope, price, duration and other purchase conditions are displayed before payment.

Payments are made using the payment methods available during checkout. By completing a purchase, the user accepts these Terms and the purchase conditions displayed before payment.

Monthly listing packages renew automatically each month until the user cancels the subscription. Cancellation prevents future renewals and takes effect at the end of the period already paid for.

Complaints, subscription cancellations and refund requests concerning purchased listing rights are handled in accordance with the Refund and Complaints Policy published at https://autoservice.world/refund-policy/.

Payments for products or services listed by users are not made through AUTOSERVICE.world. The price, payment, delivery and other transaction terms are agreed directly between the buyer and the seller or service provider identified in the listing.

Amendments to the Terms

The Portal Owner reserves the right to modify or supplement these Terms in accordance with applicable law.

Amendments take effect on the date of publication on the Portal unless a different effective date is stated or required by applicable mandatory law.

Final Provisions

These Terms are governed by the laws of the Republic of Croatia, unless otherwise required by applicable mandatory law.

Disputes arising from or in connection with the use of the Portal are subject to the jurisdiction of the competent court at the registered seat of the Portal Owner, unless otherwise required by applicable mandatory law.

HR — Opći uvjeti i odredbe korištenja

Temeljne odredbe

Ovim Općim uvjetima i odredbama korištenja (u daljnjem tekstu: Uvjeti) uređuje se korištenje internetskog portala www.autoservice.world, kojim upravlja Melior Consuasor d.o.o. sa sjedištem na adresi Vladimira Nazora 10, 10431 Brezje, Hrvatska, OIB 86651636991 (u daljnjem tekstu: Vlasnik Portala).

Melior Consuasor d.o.o. posluje pod poslovnim imenom AUTOSERVICE.WORLD.

Melior Consuasor d.o.o. putem Portala registriranim poslovnim korisnicima prodaje digitalna prava objave oglasa, dostupna kao jednokratni paketi oglasa ili mjesečne pretplate.

Odvojeno od te usluge, Portal registriranim poslovnim korisnicima omogućuje samostalnu objavu vlastitih oglasa. Sama objava oglasa na Portalu ne čini Portal ni Vlasnika Portala prodavateljem odnosno pružateljem oglašene usluge. Prodavatelj odnosno pružatelj usluge jest osoba ili poslovni subjekt koji je kao takav naveden u konkretnom oglasu.

Definicije pojmova

Portal je internetski portal www.autoservice.world namijenjen poslovnoj suradnji, trgovini i razmjeni između autoservisa.

Vlasnik Portala je Melior Consuasor d.o.o.

Korisnik je svaka osoba koja pristupa Portalu ili ga koristi, uključujući neregistrirane posjetitelje, registrirane korisnike i poslovne subjekte koji se koriste uslugama Portala na temelju ugovornog odnosa.

Digitalna prava objave oglasa jesu prava kupljena od društva Melior Consuasor d.o.o. koja registriranom poslovnom korisniku omogućuju objavu određenog broja oglasa prema uvjetima prikazanima prije kupnje.

Prodavatelj odnosno pružatelj usluge jest osoba ili poslovni subjekt koji je kao prodavatelj odnosno pružatelj usluge naveden u konkretnom oglasu.

Opće odredbe

Pristupanjem Portalu ili njegovim korištenjem korisnik se obvezuje pridržavati ovih Uvjeta.

Vlasnik Portala zadržava pravo izmijeniti, dopuniti ili ažurirati ove Uvjete. Izmjene stupaju na snagu danom objave, osim ako je navedeno drukčije ili ako primjenjivi prisilni propisi zahtijevaju drukčije. Korisnici su odgovorni za provjeru aktualnih Uvjeta prilikom korištenja Portala.

Registracija i korisnički račun

Registracija korisnika

Za korištenje određenih funkcionalnosti i usluga Portala potrebni su registracija i otvaranje korisničkog računa. Otvaranje poslovnog korisničkog računa na AUTOSERVICE.world besplatno je.

Prilikom registracije korisnik mora unijeti točne, potpune i ažurne podatke te ih održavati ažurnima tijekom korištenja Portala. Korisnik odgovara za točnost svih dostavljenih podataka.

Registracijom korisnik potvrđuje da je ovlašten koristiti dostavljene podatke te da su svi podaci dostavljeni Portalu istiniti i zakoniti.

Vlasnik Portala zadržava pravo provjeriti identitet korisnika, status poslovnog subjekta ili druge podatke relevantne za korištenje usluga Portala.

Uklanjanje sadržaja i korisničkih računa

Vlasnik Portala može, u skladu s ovim Uvjetima i primjenjivim propisima, privremeno ili trajno ukloniti sadržaj objavljen na Portalu ako utvrdi da je sadržaj neprimjeren, nezakonit, netočan, obmanjujući, uvredljiv ili na drugi način protivan primjenjivim propisima, ovim Uvjetima ili namjeni Portala.

Neprimjerenim sadržajem smatra se osobito sadržaj koji nije povezan s djelatnostima za koje je Portal namijenjen, kojim se krše prava trećih osoba, koji sadržava neistinite ili obmanjujuće informacije, promiče nezakonite aktivnosti ili na drugi način ugrožava ugled, sigurnost ili funkcionalnost Portala.

Vlasnik Portala može privremeno ograničiti ili trajno onemogućiti pristup korisničkom računu ako korisnik krši ove Uvjete, objavljuje neprimjeren sadržaj ili koristi Portal protivno njegovoj namjeni.

U slučaju teže ili ponovljene povrede Vlasnik Portala može trajno ukloniti korisnički račun zajedno sa sadržajem objavljenim putem tog računa. Korisnik nema pravo na naknadu štete samo zbog poduzimanja takve mjere. Eventualno pravo na povrat sredstava za kupljena prava objave oglasa utvrđuje se u skladu s Politikom reklamacija i povrata sredstava te primjenjivim prisilnim propisima.

Obveze i odgovornosti korisnika

Korisnik mora koristiti Portal u skladu s primjenjivim propisima, ovim Uvjetima i dobrim poslovnim običajima.

Korisnik je isključivo odgovoran za točnost, potpunost i zakonitost svih podataka, oglasa i sadržaja objavljenih putem njegova računa.

Korisnik ne smije:

• objavljivati netočne, obmanjujuće ili nepotpune informacije;
• objavljivati sadržaj kojim se krše prava trećih osoba, uključujući prava intelektualnog vlasništva;
• koristiti Portal radi prijevare, nezakonitih aktivnosti ili bilo kojeg oblika zlouporabe;
• objavljivati sadržaj koji nije u skladu s namjenom Portala;
• objavljivati sadržaj koji je uvredljiv, diskriminirajući, nezakonit ili na drugi način štetan za druge korisnike ili Vlasnika Portala;
• pokušavati neovlašteno pristupiti Portalu, drugim korisničkim računima ili podacima; ili
• ometati rad Portala ili ugrožavati njegovu sigurnost ili funkcionalnost.

Korisnik je odgovoran za sve aktivnosti provedene putem svojeg korisničkog računa, neovisno o tome je li ih proveo sam korisnik ili treća osoba kojoj su bili dostupni korisnikovi pristupni podaci.

Ako korisnik prekrši ove Uvjete, Vlasnik Portala može ukloniti sadržaj, ograničiti pristup ili deaktivirati račun u skladu s ovim Uvjetima i primjenjivim propisima.

Oglasi i objavljeni sadržaj

Korisnici mogu putem Portala objavljivati oglase isključivo radi poslovne suradnje unutar djelatnosti za koje je Portal namijenjen.

Korisnik jamči da su svi podaci objavljeni u oglasu točni, potpuni i ažurni te da ne dovode druge korisnike u zabludu.

Objavljeni sadržaj mora biti u skladu s primjenjivim propisima, ovim Uvjetima i namjenom Portala.

Korisnici ne smiju objavljivati sadržaj koji, prema razumnoj procjeni Vlasnika Portala i u skladu s uređivačkom politikom Portala:

• nije povezan s djelatnošću autoservisa ili povezanim proizvodima ili uslugama;
• sadržava netočne, obmanjujuće ili neistinite informacije;
• krši prava trećih osoba, uključujući prava intelektualnog vlasništva;
• promiče nezakonite aktivnosti, proizvode ili usluge ili se na njih odnosi; ili
• ugrožava ugled, sigurnost ili funkcionalnost Portala.

Vlasnik Portala ne kreira niti odobrava oglase koje objavljuju korisnici i ne preuzima odgovornost za točnost, potpunost ili zakonitost podataka koje su dostavili korisnici.

Vlasnik Portala može, u skladu s ovim Uvjetima i primjenjivim propisima, ukloniti ili izmijeniti sadržaj odnosno ograničiti pristup sadržaju koji krši ove Uvjete ili nije u skladu s namjenom Portala.

Odgovornost Portala

U odnosu na proizvode i usluge koje korisnici oglašavaju, Portal pruža tehničku funkcionalnost za objavu oglasa i povezivanje korisnika. Objava oglasa ne čini Vlasnika Portala stranom ugovora između kupca i prodavatelja odnosno pružatelja usluge navedenog u tom oglasu.

Vlasnik Portala ne jamči za točnost, potpunost, zakonitost, kvalitetu, sigurnost ili dostupnost proizvoda, usluga ili informacija koje korisnici oglašavaju.

Korisnici samostalno preuzimaju rizike povezane sa sklapanjem i izvršenjem poslovnih transakcija koje se odnose na proizvode ili usluge oglašene na Portalu.

U mjeri dopuštenoj primjenjivim propisima Vlasnik Portala ne odgovara za izravnu ili neizravnu štetu, gubitak dobiti, gubitak podataka ili druge posljedice nastale poslovanjem između korisnika ili povezane s proizvodima, uslugama ili informacijama koje korisnici oglašavaju. Ovim Uvjetima ne isključuje se niti ograničava odgovornost koju prema primjenjivim propisima nije dopušteno isključiti ili ograničiti.

Vlasnik Portala ne odlučuje o sporovima između kupaca i prodavatelja odnosno pružatelja usluga. Međutim, nakon prijave spora, zlouporabe ili sumnje na povredu ovih Uvjeta, Vlasnik Portala može provjeriti način korištenja Portala te, kada je to opravdano, ograničiti pristup korisničkom računu ili sadržaju.

Ovaj odjeljak ne ograničava obveze društva Melior Consuasor d.o.o. povezane s digitalnim pravima objave oglasa koja prodaje Melior Consuasor d.o.o.

Poslovni odnosi između korisnika

Poslovni odnosi povezani s proizvodima ili uslugama koje korisnici oglašavaju nastaju izravno između kupca i prodavatelja odnosno pružatelja usluge navedenog u odgovarajućem oglasu.

Prodavatelj odnosno pružatelj usluge naveden u oglasu odgovoran je za oglašeni proizvod ili uslugu, točnost podataka u oglasu, dogovorene uvjete, cijenu, plaćanje, isporuku, izvršenje ugovora, reklamacije, povrate proizvoda i povrate sredstava.

Kupac reklamacije, povrate proizvoda, zahtjeve za povrat sredstava i druge sporove povezane s oglašenim proizvodom ili uslugom rješava izravno s prodavateljem odnosno pružateljem usluge navedenim u oglasu.

Vlasnik Portala ne odgovara za ispunjenje obveza koje proizlaze iz takvog poslovnog odnosa, uključujući kvalitetu, sukladnost, zakonitost, dostupnost, isporuku ili plaćanje odgovarajućeg proizvoda ili usluge, osim kada takva odgovornost proizlazi iz primjenjivih prisilnih propisa.

Zaštita osobnih podataka

Osobni podaci korisnika prikupljaju se i obrađuju u skladu s primjenjivim propisima o zaštiti osobnih podataka i Politikom privatnosti objavljenom na Portalu.

Korištenjem Portala korisnik potvrđuje da je informiran o obradi osobnih podataka.

Intelektualno vlasništvo

Sadržaj koji pruža Vlasnik Portala, uključujući tekstove, logotipe, grafičke elemente, dizajn, baze podataka i softver, zaštićen je primjenjivim pravima intelektualnog vlasništva.

Kopiranje, distribuiranje, izmjena ili drugo korištenje sadržaja koji pruža Vlasnik Portala zabranjeno je bez prethodnog pisanog odobrenja, osim kada je dopušteno primjenjivim propisima.

Korisnik zadržava prava na sadržaj koji objavljuje. Korisnik Vlasniku Portala daje pravo koristiti taj sadržaj u opsegu potrebnom za funkcioniranje, prikazivanje i promociju Portala i korisnikovih oglasa.

Plaćanja i pretplate

Melior Consuasor d.o.o. prodaje digitalna prava objave oglasa kao jednokratne pakete oglasa i mjesečne pretplate. Točan opseg, cijena, trajanje i ostali uvjeti kupnje prikazuju se prije plaćanja.

Plaćanja se obavljaju načinima plaćanja dostupnima tijekom dovršetka kupnje. Dovršetkom kupnje korisnik prihvaća ove Uvjete i uvjete kupnje prikazane prije plaćanja.

Mjesečni paketi oglasa automatski se obnavljaju svakog mjeseca dok korisnik ne otkaže pretplatu. Otkazivanje sprječava buduća obnavljanja i stupa na snagu na kraju već plaćenog razdoblja.

Reklamacije, otkazivanja pretplate i zahtjevi za povrat sredstava povezani s kupljenim pravima objave oglasa rješavaju se u skladu s Politikom reklamacija i povrata sredstava objavljenom na https://autoservice.world/refund-policy/.

Plaćanja za proizvode ili usluge koje korisnici oglašavaju ne obavljaju se putem AUTOSERVICE.world. Cijenu, plaćanje, isporuku i ostale uvjete transakcije kupac dogovara izravno s prodavateljem odnosno pružateljem usluge navedenim u oglasu.

Izmjene Uvjeta

Vlasnik Portala zadržava pravo izmijeniti ili dopuniti ove Uvjete u skladu s primjenjivim propisima.

Izmjene stupaju na snagu danom objave na Portalu, osim ako je naveden drugi datum stupanja na snagu ili ako primjenjivi prisilni propisi zahtijevaju drukčije.

Završne odredbe

Na ove Uvjete primjenjuje se pravo Republike Hrvatske, osim ako primjenjivi prisilni propisi zahtijevaju drukčije.

Za sporove koji proizlaze iz korištenja Portala ili su s njim povezani nadležan je stvarno nadležni sud prema sjedištu Vlasnika Portala, osim ako primjenjivi prisilni propisi zahtijevaju drukčije.
