Fundamental Provisions
These Terms and Conditions (hereinafter: Terms) govern the rules of use of the internet portal www.autoservice.world, managed by Melior Consuasor d.o.o. with its registered address at Vladimira Nazora 10, 10431 Brezje, Croatia, OIB 86651636991 (hereinafter: Portal Owner).
Melior Consuasor d.o.o. operates under the trading name AUTOSERVICE.WORLD.
AUTOSERVICE.world offers digital listing packages, available as one-time purchases or monthly subscriptions, for registered business users of the Portal.

For transactions completed through Paddle Checkout, Paddle acts as the authorized reseller of AUTOSERVICE.world digital listing packages and as Merchant of Record for the transaction. “Paddle” means the applicable Paddle contracting entity identified in the Paddle Buyer Terms according to the buyer’s location.

Paddle processes payments for AUTOSERVICE.world digital listing packages, calculates and collects applicable taxes, issues transaction invoices, and administers refunds in accordance with the Paddle Buyer Terms and Paddle Refund Policy.

Paddle does not process payments for vehicles, spare parts, workshop equipment, or third-party services listed by users on the Portal. Any business relationship or transaction between users takes place independently between those users.

Definitions
Portal is the internet portal www.autoservice.world intended for business cooperation, trade, and exchange between automotive service providers.
User is any person who accesses and/or uses the services of the internet portal www.autoservice.world, including unregistered users, registered users, and business entities that use the Portal’s services on the basis of a contractual relationship.

General Provisions
By accessing this website, you accept all rules and conditions of use of the internet portal www.autoservice.world. We reserve the right to modify, supplement, or update these Terms and Conditions at any time. All modifications and amendments take effect on the date of their publication. Users are obliged to regularly monitor the current Terms and Conditions, and by using the website, it is considered that they are familiar with the current terms.

Registration and User Account
User Registration
To use certain functionalities and services of the Portal, registration and creation of a user account is required.Creating an AUTOSERVICE.world business account is free and does not require payment.
During registration, the user is obliged to provide accurate, complete, and up-to-date information and to maintain its accuracy throughout the entire period of using the Portal. The user bears responsibility for the accuracy of all submitted data.
By registering, the user confirms that they are authorized to use the entered data and that all data submitted to the Portal is true and lawful.
The Portal Owner reserves the right to verify the identity of the user, the status of the business entity, or other data relevant for the use of the Portal’s services.

Removal of Content and User Accounts
The Portal Owner reserves the right, at its own discretion and without prior notice, to temporarily or permanently remove any content published on the Portal if it determines that such content is inappropriate, unlawful, inaccurate, misleading, offensive, or in any way contrary to applicable regulations, these Terms and Conditions, or the purpose of the Portal.
Inappropriate content is considered to be, in particular, content that is not related to the activities for which the Portal is intended, content that violates the rights of third parties, publishes false or misleading data, promotes unlawful activities, or otherwise undermines the reputation, security, and functionality of the Portal.
The Portal Owner also reserves the right to temporarily restrict or permanently disable access to the user account of any user who violates these Terms and Conditions, publishes inappropriate content, or uses the Portal contrary to its intended purpose.
In case of more serious or repeated violations, the Portal Owner may permanently remove the user account together with all content that the user has published on the Portal, without the right to compensation for any damages or refund of previously paid fees, unless otherwise prescribed by applicable law.

Obligations and Responsibilities of the User
The user undertakes to use the Portal in accordance with applicable regulations, these Terms, and good business practices.
The user is exclusively responsible for the accuracy, completeness, and lawfulness of all data, listings, and content they publish on the Portal.
The user undertakes not to:
– Publish inaccurate, misleading, or incomplete information,
– Publish content that violates the rights of third parties, including intellectual property rights,
– Use the Portal for the purpose of fraud, unlawful activities, or any form of abuse,
– Publish content that is not in accordance with the purpose of the Portal,
– Publish content that is offensive, discriminatory, unlawful, or in any other way harmful to other users or the Portal Owner,
– Attempt to gain unauthorized access to the Portal, other user accounts, or data,
– Disrupt the operation of the Portal or compromise its security and functionality.

The user is responsible for all activities carried out through their user account, regardless of whether they were performed by the user themselves or a third party to whom their access data was available.
In case of violation of these Terms, the Portal Owner reserves the right to remove content, restrict access, or deactivate the account without prior notice.

Listings and Published Content
Users may publish listings on the Portal exclusively for the purpose of business cooperation within the activity for which the Portal is intended.
The user guarantees that all data published in listings is accurate, complete, and up-to-date, and that it does not mislead other users.
Published content must be in accordance with applicable regulations, these Terms, and the purpose of the Portal.
The user is not permitted to publish content that, at the discretion of the Portal Owner and in accordance with the editorial policy of the Portal:
– Is not related to the automotive service activity or related products or services,
– Contains inaccurate, misleading, or false information,
– Violates the rights of third parties, including intellectual property rights,
– Promotes or relates to unlawful activities, products, or services,
– In any way undermines the reputation, security, or functionality of the Portal.

The Portal Owner does not participate in the creation, verification, or approval of published content and does not assume responsibility for its accuracy, completeness, or lawfulness.
The Portal Owner reserves the right, without prior notice, to remove, modify, or restrict access to any content that is contrary to these Terms or is not in accordance with the purpose of the Portal.

Liability of the Portal
The Portal Owner provides exclusively a technical platform for connecting users and does not participate in any purchase, exchange, or conclusion of any agreements between users.
All business relationships, negotiations, transactions, and any eventual contracts are concluded exclusively between users, whereby the Portal Owner is not a contractual party or intermediary in these relationships.
The Portal Owner does not guarantee the accuracy, completeness, lawfulness, quality, security, or availability of any products, services, or information published by users.
Users independently assume all risks arising from the use of the Portal, including, but not limited to, risks related to the conclusion and execution of business transactions with other users.
The Portal Owner is not liable for any direct or indirect damages, loss of profit, loss of data, or other consequences arising from the use of the Portal or business dealings between users, except in cases where such liability is prescribed by mandatory legal provisions.
The Portal Owner does not participate in the resolution of disputes between users, but may, at its own discretion, temporarily restrict or disable access to user accounts or content in case of a reported dispute, abuse, or suspicion of a violation of these Terms.

Business Relationships Between Users
Users enter into business relationships with each other exclusively independently and at their own risk. All negotiations, agreements, purchases, exchanges, payments, and other business relationships arising from the use of the Portal take place exclusively between users.
The Portal Owner is not a party to any contractual relationship that arises between users, nor does it participate in its conclusion, execution, or termination.
The Portal Owner does not assume responsibility for the fulfillment of obligations arising from business relationships between users, including, but not limited to, the quality, correctness, lawfulness, availability, delivery, or payment of goods and services.
All disputes arising from business relationships between users are resolved exclusively between the users themselves, without the participation of the Portal Owner, unless the Portal Owner, at its own discretion, decides to restrict or disable a user’s access in accordance with these Terms.

Personal Data Protection
The collection and processing of users’ personal data is carried out in accordance with applicable personal data protection regulations and the Privacy Policy published on the Portal.
By using the Portal, the user confirms that they are familiar with the method of processing personal data.

Intellectual Property
All content available on the Portal, including text, logos, graphic elements, design, databases, and software, is protected by the intellectual property rights of the Portal Owner.
Copying, distribution, modification, or any other use of the Portal’s content is not permitted without the prior written consent of the Portal Owner, unless otherwise permitted by applicable regulations.
The user retains the rights to the content they publish themselves, and the Portal Owner acquires the right to use such content for the purpose of the operation and promotion of the Portal.

Payments and Subscriptions
Payments for AUTOSERVICE.world digital listing packages are completed through Paddle Checkout. For these transactions, Paddle acts as the authorized reseller and Merchant of Record. “Paddle” means the applicable Paddle contracting entity identified in the Paddle Buyer Terms according to the buyer’s location.

By completing a purchase through Paddle Checkout, the user agrees to the applicable Paddle Buyer Terms.

AUTOSERVICE.world offers digital listing packages as one-time purchases and monthly subscriptions. Monthly subscriptions renew every month until canceled. Cancellation takes effect at the end of the current billing period.

Paddle calculates and collects applicable taxes, issues transaction invoices, and administers refunds in accordance with the Paddle Buyer Terms and Paddle Refund Policy.

Paddle processes payments only for AUTOSERVICE.world digital listing packages. Paddle does not process payments for vehicles, spare parts, workshop equipment, or third-party services listed by users on the Portal, and does not process transactions between users.

Amendments to the General Terms
The Portal Owner reserves the right to modify or supplement these General Terms and Conditions at any time.
Amendments to the General Terms take effect on the date of publication on the Portal and from that moment apply to all users.

Final Provisions
The laws of the Republic of Croatia apply to these General Terms and Conditions, unless otherwise determined by mandatory provisions.
For all disputes arising from or in connection with the use of the Portal, the court with material jurisdiction according to the seat of the Portal Owner shall be competent, unless otherwise determined by mandatory provisions.

Temeljne odredbe
Ovim Općim uvjetima i odredbama korištenja (u daljnjem tekstu: Uvjeti) uređuju se pravila korištenja internetskog portala www.autoservice.world, kojim upravlja Melior Consuasor d.o.o. sa sjedištem na adresi Vladimira Nazora 10, 10431 Brezje, Hrvatska, OIB 86651636991 (u daljnjem tekstu: Vlasnik portala).
Melior Consuasor d.o.o. posluje pod poslovnim imenom AUTOSERVICE.WORLD.

AUTOSERVICE.world nudi digitalne pakete listinga, dostupne kao jednokratne kupnje ili mjesečne pretplate, registriranim poslovnim korisnicima Portala.

Za transakcije dovršene putem Paddle Checkouta, Paddle djeluje kao ovlašteni preprodavatelj digitalnih paketa listinga AUTOSERVICE.world i kao Merchant of Record za transakciju. “Paddle” označava odgovarajuću ugovornu stranu društva Paddle navedenu u Paddleovim Uvjetima za kupce, ovisno o lokaciji kupca.

Paddle obrađuje plaćanja za digitalne pakete listinga AUTOSERVICE.world, obračunava i naplaćuje primjenjive poreze, izdaje račune za transakcije te upravlja povratima sredstava u skladu s Paddleovim Uvjetima za kupce i Paddleovom Politikom povrata.

Paddle ne obrađuje plaćanja za vozila, rezervne dijelove, opremu za radionice ili usluge trećih strana koje korisnici objavljuju na Portalu. Svi poslovni odnosi ili transakcije između korisnika odvijaju se neovisno između tih korisnika.

Definicije pojmova
Portal je internetski portal www.autoservice.world namijenjen za poslovnu suradnju, trgovinu i razmjenu između autoservisa.
Korisnik je svaka osoba koja pristupa i/ili koristi usluge internetskog portala www.autoservice.world, što podrazumijeva neregistrirane korisnike, registrirane korisnike i poslovne subjekte koji se na osnovi ugovornog odnosa koriste uslugama Portala.

Opće odredbe
Pristupanjem ovim stranicama prihvaćate sva pravila i uvjete korištenja internetskog portala www.autoservice.world. Zadržavamo pravo u bilo kojem trenutku izmijeniti, dopuniti ili ažurirati ove Uvjete i odredbe korištenja. Sve izmjene i dopune stupaju na snagu danom njihove objave. Korisnici su dužni redovito pratiti važeće Uvjete i odredbe korištenja, a korištenjem stranice smatra se da su upoznati s važećim uvjetima.

Registracija i korisnički račun
Registracija korisnika
Za korištenje određenih funkcionalnosti i usluga Portala potrebno je izvršiti registraciju i otvoriti korisnički račun.Otvaranje poslovnog korisničkog računa na AUTOSERVICE.world je besplatno i ne zahtijeva plaćanje.
Prilikom registracije korisnik je obvezan unijeti točne, potpune i ažurne podatke te ih održavati ažurnima tijekom cijelog razdoblja korištenja Portala. Korisnik snosi odgovornost za točnost svih dostavljenih podataka.
Registracijom korisnik potvrđuje da je ovlašten koristiti unesene podatke te da su svi podaci dostavljeni Portalu istiniti i zakoniti.
Vlasnik Portala zadržava pravo provjere identiteta korisnika, statusa poslovnog subjekta ili drugih podataka relevantnih za korištenje usluga Portala.

Uklanjanje sadržaja i korisničkih računa
Vlasnik portala zadržava pravo, prema vlastitoj procjeni i bez prethodne obavijesti, privremeno ili trajno ukloniti bilo koji sadržaj objavljen na Portalu ako utvrdi da je isti neprimjeren, nezakonit, netočan, obmanjujući, uvredljiv ili na bilo koji način protivan važećim propisima, ovim Uvjetima i odredbama korištenja ili namjeni Portala.
Neprimjerenim sadržajem smatra se osobito sadržaj koji nije povezan s djelatnostima za koje je Portal namijenjen, sadržaj kojim se krše prava trećih osoba, objavljuju lažni ili obmanjujući podaci, promoviraju nezakonite aktivnosti ili na drugi način narušava ugled, sigurnost i funkcionalnost Portala.
Vlasnik portala također zadržava pravo privremeno ograničiti ili trajno onemogućiti pristup korisničkom računu korisnika koji krši ove Uvjete i odredbe korištenja, objavljuje neprimjeren sadržaj ili koristi Portal protivno njegovoj namjeni.
U slučaju težih ili ponovljenih povreda, Vlasnik portala može trajno ukloniti korisnički račun zajedno sa svim sadržajem koji je korisnik objavio na Portalu, bez prava na naknadu eventualne štete ili povrat prethodno uplaćenih naknada, osim ako je drukčije propisano važećim zakonima.

Obveze i odgovornosti korisnika
Korisnik se obvezuje koristiti Portal u skladu s važećim propisima, ovim Uvjetima te dobrim poslovnim običajima.
Korisnik je isključivo odgovoran za točnost, potpunost i zakonitost svih podataka, listinga i sadržaja koje objavljuje na Portalu.
Korisnik se obvezuje da neće:
Objavljivati netočne, obmanjujuće ili nepotpune informacije,
Objavljivati sadržaj koji krši prava trećih osoba, uključujući prava intelektualnog vlasništva,
Koristiti Portal u svrhu prijevare, nezakonitih aktivnosti ili bilo kojeg oblika zlouporabe,
Objavljivati sadržaj koji nije u skladu s namjenom Portala,
Objavljivati sadržaj koji je uvredljiv, diskriminirajući, nezakonit ili na bilo koji drugi način štetan za druge korisnike ili vlasnika Portala,
Pokušavati neovlašteno pristupiti Portalu, drugim korisničkim računima ili podacima,
Ometati rad Portala ili narušavati njegovu sigurnost i funkcionalnost.

Korisnik je odgovoran za sve aktivnosti koje se poduzimaju putem njegovog korisničkog računa, neovisno o tome je li ih poduzeo sam korisnik ili treća osoba kojoj su njegovi pristupni podaci bili dostupni.
U slučaju povrede ovih Uvjeta, vlasnik Portala zadržava pravo bez prethodne obavijesti ukloniti sadržaj, ograničiti pristup ili deaktivirati račun.

Listinzi i objavljeni sadržaj
Korisnici mogu putem Portala objavljivati listinge isključivo u svrhu poslovne suradnje unutar djelatnosti za koju je Portal namijenjen.
Korisnik jamči da su svi podaci objavljeni u listinzima točni, potpuni i ažurni te da ne dovode u zabludu druge korisnike.
Objavljeni sadržaj mora biti u skladu s važećim propisima, ovim Uvjetima te namjenom Portala.
Korisniku nije dopušteno objavljivati sadržaj koji, prema procjeni vlasnika Portala i u skladu s uređivačkom politikom Portala:
Nije povezan s djelatnošću autoservisa ili povezanim proizvodima ili uslugama,
Sadrži netočne, obmanjujuće ili neistinite informacije,
Krši prava trećih osoba, uključujući prava intelektualnog vlasništva,
Promiče ili se odnosi na nezakonite aktivnosti, proizvode ili usluge,
Na bilo koji način narušava ugled, sigurnost ili funkcionalnost Portala.

Vlasnik portala ne sudjeluje u kreiranju, provjeri niti odobravanju objavljenog sadržaja te ne preuzima odgovornost za njegovu točnost, potpunost ili zakonitost.
Vlasnik portala zadržava pravo, bez prethodne obavijesti, ukloniti, izmijeniti ili ograničiti pristup bilo kojem sadržaju koji je u suprotnosti s ovim Uvjetima ili nije u skladu s namjenom Portala.

Odgovornost Portala

Vlasnik Portala pruža isključivo tehničku platformu za povezivanje korisnika te ne sudjeluje u kupoprodaji, razmjeni ili sklapanju bilo kakvih ugovora između korisnika.
Svi poslovni odnosi, pregovori, transakcije te eventualni ugovori sklapaju se isključivo između korisnika, pri čemu vlasnik Portala nije ugovorna strana niti posrednik u tim odnosima.
Vlasnik Portala ne jamči za točnost, potpunost, zakonitost, kvalitetu, sigurnost niti dostupnost bilo kojih proizvoda, usluga ili informacija koje objavljuju korisnici.
Korisnici samostalno preuzimaju sve rizike koji proizlaze iz korištenja Portala, uključujući, ali ne ograničavajući se na, rizike vezane uz sklapanje i izvršenje poslovnih transakcija s drugim korisnicima.
Vlasnik Portala ne odgovara za bilo kakvu izravnu ili neizravnu štetu, gubitak dobiti, gubitak podataka ili druge posljedice nastale korištenjem Portala ili poslovanjem između korisnika, osim u slučajevima kada je takva odgovornost propisana prisilnim zakonskim propisima.
Vlasnik Portala ne sudjeluje u rješavanju sporova između korisnika, ali može, prema vlastitoj procjeni, privremeno ograničiti ili onemogućiti pristup korisničkim računima ili sadržaju u slučaju prijave spora, zlouporabe ili sumnje na povredu ovih Uvjeta.

Poslovni odnosi između korisnika
Korisnici međusobno stupaju u poslovne odnose isključivo samostalno i na vlastitu odgovornost. Svi pregovori, dogovori, kupoprodaje, razmjene, plaćanja te drugi poslovni odnosi koji proizlaze iz korištenja Portala odvijaju se isključivo između korisnika.
Vlasnik Portala nije strana u bilo kojem ugovornom odnosu koji nastane između korisnika, niti sudjeluje u njegovom sklapanju, izvršenju ili raskidu.
Vlasnik Portala ne preuzima odgovornost za ispunjenje obveza koje proizlaze iz poslovnih odnosa između korisnika, uključujući, ali ne ograničavajući se na kvalitetu, ispravnost, zakonitost, dostupnost, isporuku ili plaćanje robe i usluga.
Svi eventualni sporovi koji proizlaze iz poslovnih odnosa između korisnika rješavaju se isključivo između samih korisnika, bez sudjelovanja vlasnika Portala, osim ako vlasnik Portala prema vlastitoj procjeni ne odluči ograničiti ili onemogućiti pristup korisniku sukladno ovim Uvjetima.

Zaštita osobnih podataka
Prikupljanje i obrada osobnih podataka korisnika provodi se u skladu s važećim propisima o zaštiti osobnih podataka te Politikom privatnosti objavljenom na Portalu.
Korištenjem Portala korisnik potvrđuje da je upoznat s načinom obrade osobnih podataka.

Intelektualno vlasništvo
Svi sadržaji dostupni na Portalu, uključujući tekstove, logotipe, grafičke elemente, dizajn, baze podataka i softver, zaštićeni su pravima intelektualnog vlasništva vlasnika Portala.
Nije dopušteno kopiranje, distribucija, izmjena ili bilo kakvo drugo korištenje sadržaja Portala bez prethodnog pisanog odobrenja vlasnika Portala, osim ako je drukčije dopušteno važećim propisima.
Korisnik zadržava prava na sadržaj koji sam objavi, a vlasnik Portala stječe pravo korištenja takvog sadržaja u svrhu funkcioniranja i promocije Portala.

Plaćanja i pretplate

Plaćanja digitalnih paketa listinga AUTOSERVICE.world obavljaju se putem Paddle Checkouta. Za te transakcije Paddle djeluje kao ovlašteni preprodavatelj i Merchant of Record. “Paddle” označava odgovarajuću ugovornu stranu društva Paddle navedenu u Paddleovim Uvjetima za kupce, ovisno o lokaciji kupca.

Dovršetkom kupnje putem Paddle Checkouta korisnik prihvaća primjenjive Paddleove Uvjete za kupce.

AUTOSERVICE.world nudi digitalne pakete listinga kao jednokratne kupnje i mjesečne pretplate. Mjesečne pretplate automatski se obnavljaju svakog mjeseca dok se ne otkažu. Otkazivanje stupa na snagu na kraju tekućeg razdoblja naplate.

Paddle obračunava i naplaćuje primjenjive poreze, izdaje račune za transakcije te upravlja povratima sredstava u skladu s Paddleovim Uvjetima za kupce i Paddleovom Politikom povrata.

Paddle obrađuje plaćanja isključivo za digitalne pakete listinga AUTOSERVICE.world. Paddle ne obrađuje plaćanja za vozila, rezervne dijelove, opremu za radionice ili usluge trećih strana koje korisnici objavljuju na Portalu niti obrađuje transakcije između korisnika.

Izmjene Općih uvjeta
Vlasnik Portala zadržava pravo u svakom trenutku izmijeniti ili dopuniti ove Opće uvjete i odredbe korištenja.
Izmjene Općih uvjeta stupaju na snagu danom objave na Portalu te se od tog trenutka primjenjuju na sve korisnike.

Završne odredbe
Na ove Opće uvjete i odredbe korištenja primjenjuje se pravo Republike Hrvatske, osim ako prisilnim propisima nije drugačije određeno.
Za sve sporove koji proizlaze iz ili su u vezi s korištenjem Portala nadležan je stvarno nadležni sud prema sjedištu vlasnika Portala, osim ako je prisilnim propisima određeno drugačije.
